Can I break my lease if they didn’t tell me about lead paint?
My landlord didn’t tell me that we had lead paint in the apartment and I have 2 children, 3 1/2 and 1. I know that lead poisoning is possible and dangerous because if my children were to ingest a paint chip and got lead poisoning, they could get brain damage. I read up on it and she was required to tell me about it and give me a brochure before I moved in. She call me about a month later, as an, “oh, by the way” kind of thing. I want to move; can I terminate the lease early bacause she didn’t tell about this?
Probably. What she did implies that she was aware of the lead when she leased to you. It is possible that the lead is not in a condition that children would ingest it. If it has been covered with a coating that prevents it flaking. Is it flaking off (that’s where the “chips” would come from) or chalking off? If not, then there is little danger but it is normal to be afraid. We are all trained to be afraid of most everything so that we are easier to oppress buy business/government.
Call you local health department and ask for information about lead paint. Tell them that your landlord disclosed the existence of lead paint in the building after the lease had been signed.
